Terms of Service
Effective date: August 19, 2026
These Terms of Service (“Terms”) are a binding agreement between you and AlgoMash Health, Inc. (“AlgoMash,” “we,” “us,” or “our”), a Delaware corporation. They govern your access to and use of algomash.com, our intake quiz, dashboard, and related services (collectively, the “Services”).
By creating an account, completing the intake quiz, checking the “I agree” box at sign-up, or otherwise using the Services, you accept these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
1. Eligibility
You may use the Services only if you:
- are at least 18 years old and a legal resident of the United States;
- reside in a state where AlgoMash and its affiliated providers are licensed to offer the requested treatment;
- can form a legally binding contract with us and are not barred from using the Services under applicable law; and
- provide true, current, and complete information about yourself.
We may verify your identity, age, and location at any time and may deny or discontinue Services if you do not meet these requirements or if we cannot verify the information you provide.
2. Not for Emergencies
AlgoMash is not an emergency service. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Services to seek emergency medical treatment or to communicate time-sensitive medical information.
3. Description of the Services
AlgoMash operates a telehealth platform that connects you with independent, licensed healthcare providers for evaluation and, where clinically appropriate, treatment with GLP-1 medications (such as semaglutide and tirzepatide). Specifically:
- You complete an online intake questionnaire describing your health history, goals, and current condition.
- Your information is reviewed by a licensed clinician through our telehealth exam partner, Qualiphy, who independently decides — in their sole clinical judgment — whether to approve, deny, or request more information before prescribing any treatment.
- If approved, prescriptions are sent to a licensed, accredited pharmacy for compounding and shipment directly to you.
AlgoMash is a technology platform, not a healthcare provider, a pharmacy, or an insurer. We do not practice medicine, and we do not guarantee that any provider will evaluate you, approve treatment, or prescribe any particular medication or dosage. The clinical relationship for any diagnosis, treatment, or prescription decision is solely between you and the independent licensed provider — not with AlgoMash.
4. Medical Disclaimer
The medications made available through the Services are compounded medications prepared by licensed, accredited compounding pharmacies. They are not FDA-approved in their compounded form, although they contain the same active ingredients as FDA-approved brand-name medications. Content on our site does not constitute medical advice and is not a substitute for a relationship with your own treating physician. Individual results vary, and weight-loss outcomes depend on adherence to treatment, lifestyle factors, and individual health circumstances. These statements have not been evaluated by the Food and Drug Administration, and no product offered through the Services is intended to diagnose, treat, cure, or prevent any disease. Always disclose your complete medical history accurately — inaccurate or incomplete information can result in serious harm, and you are solely responsible for the consequences of providing it.
5. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@algomash.com if you suspect unauthorized access. You may not create an account for anyone other than yourself, share your account, or maintain more than one active account. We may suspend or terminate your account as described in Section 13.
6. Fees, Billing & Subscriptions
- Initial charge. When you check out, we charge your payment method for the first month of treatment. This charge is processed and authorized before a provider has reviewed your case, and is fully refunded if a licensed provider declines to prescribe treatment after reviewing your intake and exam.
- Recurring billing. If approved, your plan renews monthly at the then-current price and your payment method is charged automatically until you cancel. Prices are shown at checkout and may reflect dynamic, package-based pharmacy pricing that can change between billing cycles; we will provide notice before a recurring price increase takes effect on your subscription.
- Cancel anytime. You may cancel future renewals at any time from your dashboard or by contacting support@algomash.com. Cancellation takes effect at the end of your current billing period; we do not provide prorated refunds for partial billing periods except as described below.
- Refunds. Amounts already charged for medication that has been dispensed and shipped are generally non-refundable, except where required by law or where a provider declines to prescribe as described above. Shipping, processing, and payment-processor fees are non-refundable.
- Failed payments. If a payment fails, we may retry the charge, suspend your subscription, and/or pause shipments until payment succeeds.
All payments are processed by Stripe, Inc. We do not store your full payment card number. By providing payment information, you represent that you are authorized to use that payment method.
7. Prescriptions & Pharmacy Fulfillment
Medications are dispensed only pursuant to a valid prescription issued by an independent licensed provider following their own clinical evaluation. AlgoMash does not guarantee delivery timelines, and shipment schedules depend on pharmacy processing, carrier performance, and factors outside our control. Medications dispensed to you are for your personal use only. You may not resell, distribute, or transfer any medication to any other person. Misuse of prescription medication may violate federal and state law.
8. Acceptable Use
You agree not to:
- provide false, misleading, or another person’s health, identity, or payment information;
- use the Services to obtain medication for anyone other than yourself, or for any unlawful purpose;
- attempt to circumvent, probe, or interfere with the security or proper functioning of the Services, including by scraping, reverse-engineering, or introducing malicious code;
- initiate chargebacks or payment disputes in bad faith for medication that was validly dispensed; or
- use the Services in a manner that infringes the rights of AlgoMash, our providers, or any third party.
9. Third-Party Services
The Services rely on independent third parties, including telehealth exam infrastructure (Qualiphy), payment processing (Stripe), compounding pharmacies, and communications providers. We are not responsible for the acts, omissions, availability, or performance of these independent third parties, including licensed providers, who exercise their own independent professional judgment.
10. Intellectual Property
The Services, including their design, text, graphics, and software, are owned by AlgoMash or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use in accordance with these Terms. All other rights are reserved.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT ANY SPECIFIC MEDICAL RESULT, WEIGHT-LOSS OUTCOME, OR THAT ANY PROVIDER WILL APPROVE OR PRESCRIBE TREATMENT.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ALGOMASH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO ALGOMASH IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW. THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH A CLAIM IS BASED, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
13. Indemnification
You agree to defend, indemnify, and hold harmless AlgoMash and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Services; (b) inaccurate or incomplete information you provide; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party.
14. Suspension & Termination
We may suspend or terminate your access to the Services at any time, with or without notice, including if we reasonably believe you have violated these Terms, provided false information, engaged in fraud or abuse, or if a provider determines treatment is no longer clinically appropriate. You may stop using the Services and close your account at any time by contacting support@algomash.com. Sections that by their nature should survive termination (including Sections 11–13 and 15–17) will survive.
15. Dispute Resolution & Binding Arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
15.1 Agreement to Arbitrate.You and AlgoMash agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (a “Dispute”) will be resolved by binding, individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court, except as set out below. This agreement to arbitrate is governed by the Federal Arbitration Act.
15.2 Class Action & Jury Trial Waiver.You and AlgoMash each waive the right to a jury trial and to participate in a class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. If this class-action waiver is found unenforceable as to a particular Dispute, that Dispute (and only that Dispute) will proceed in court and the rest of this arbitration agreement will still apply to all other Disputes.
15.3 Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or other equitable relief in court to prevent misuse of intellectual property or unauthorized access to the Services.
15.4 Opt-Out. You may opt out of this arbitration agreement by emailing support@algomash.com with the subject line “Arbitration Opt-Out”, including your full name and account email, within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
15.5 Process. Before filing arbitration, you agree to first contact us at support@algomash.com and attempt in good faith to resolve the Dispute informally for at least 30 days.
16. Governing Law & Venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. For any Dispute not subject to arbitration under Section 15, you and AlgoMash agree to the exclusive jurisdiction and venue of the state and federal courts located in New Castle County, Delaware.
17. General Terms
- Changes to these Terms. We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Services before they take effect. Continued use of the Services after changes take effect constitutes acceptance.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any right or provision will not be a waiver of that right or provision.
- Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and AlgoMash regarding the Services.
